January is the time of year when the most couples file for divorce. It's never going to be easy, but some good advice can go a long way.

So why January? New Years are often a good opportunity for fresh starts and it avoids disruption at Christmas time.

No one can make it simple or pleasant to go through, but divorce solicitors in Harrogate, No 1 Solicitors want to help with some advice.

Do you need an official reason for divorce?

Yes. And there are five grounds for divorce here:

  1. Unreasonable behaviors
  2. Adultery
  3. Two year separation by consent
  4. Five year separation without consent
  5. Desertion

Can both parts of the couple use the same solicitor?

No. This works simply on a first come first serve basis.

Any advice for parents?

Remaining in the family home is likely to be a high priority for parents who are taking primary care of the children which can be done registering the appropriate charges on the property. Allowing children to remain in their home is a way to ensure some stability.

Establishing childcare and parent contact is best done amicably between the couple without dealing with it in court. This is easier for the children and much more cost effective.

Divorce undoubtedly has an impact on children. They may be unlikely to speak about their feelings and anxiety, but their behaviour may be quite telling. reassurance is vital.

What if one parent sacrificed their career for childcare?

This is a common situation, and it can be argued that whilst one member of the couple earns less money, by them doing so it allows the other to progress in theirs. Every case is different though, so a large part of this balances on assessing the situation financially. Something which family lawyers are experts at.

How do assess the financial situation?

Looking over employment contracts, potential promotions and bonus packages all come into consideration when deciding where and how money should be split. This can even be done further by looking at the rest of the industry market to see what salary they could expect if they changed job.

Every couple is different and therefore every divorce is different.

The best thing to do is undoubtedly to talk to an expert. If you'd like to talk to Ehsan Kabir or someone on the No 1 Solicitor team in Harrogate you can arrange a free consultation here.
